Sort of Legal-ish Query Help!

Wonder if anyone can help!

If a firm's refund policy states that refunds will take 3-5 working days...and you are still waiting despite 5 phone calls for the money to be credited back into your account after 15 days (and have incurred bank overdraft charges in the meantime cos you believed what they stated!) have you any comeback?

Just wondering whilst I fume!

Thanks for that advice, I have just bought 8 Stellas, just in case the wine is not enough!

Sounds pretty water-tight to me Marmy. You need to be very organised about it and keep a record of every phone call, every name of every person you speak to and, if you have time, bombard them every day with a call and/or letter.

Hassle them big style. Good luck girlie.

Or you have just asked me as Mr C is a Trading Standards Officer!

Basically you need to write them a letter outlining what has happened (not abusively or emotionally, just factually). Send it by Recorded Delivery. Tell them that if you have not received your money within 14 days, you will be lodging a claim against them in the Small Claims Court. Tell them you will expect them to pay your Court fees and time off work. Head the letter "Letter Before Proceedings" in large letters.

That should do the trick.

It wouldn't do any harm to put "Without prejudice" on any pre-court action correspondence too. I'm not going to go into the reasons why here.

Cool, thanks for the advice!

The mess is still ongoing, despite a ' go to any local store and they will refund there and then if you take your invoice' bit of advice after yet another call centre tangle...result, a wasted journey.

Called again and they said a cheque had been posted first class on the 25th...no sign of it yet!

Have a record of all dates of calls but no one in the call centre will give their names or put me through to anyone more senior.

I am seriously worried now, Ceri, when i write the letter does that mean I have to wait yet another 14 days for a refund? that would mean theyve had my money for over a month, they took it out within 24 hours!!! Smile

BTW the firm in question is a well known DIY store of two initials Smile
